Introduction
Welcome to Doku. These Terms of Use ("Terms") govern your access to and use of the Doku mobile application ("App") for learning French. By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the App.

Definitions
- "App" refers to the Doku mobile application for iOS and Android devices.
- "Services" refers to all features, content, and functionality provided through the App.
- "User," "you," or "your" refers to any person who accesses or uses the App.
- "Content" refers to all French learning materials, stories, exercises, quizzes, and other educational content provided in the App.
- "We," "us," or "our" refers to Yannick Herrero, the developer and operator of Doku.
License Grant
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to:
- Download and install the App on your personal mobile device(s)
- Access and use the App for your personal, non-commercial language learning purposes
- Access and use the Content provided through the App for personal educational use
This license does not include any rights to resell, redistribute, or commercially exploit the App or Content.
Intellectual Property Rights
The App and all Content, including but not limited to French learning stories, exercises, quizzes, text, graphics, logos, icons, software, and other materials, are the exclusive property of Yannick Herrero and are protected by French and international copyright, trademark, and other intellectual property laws.
All Content is original and created by Doku. You acknowledge that:
- We retain all rights, title, and interest in the App and Content
- No ownership rights are transferred to you through use of the App
- You may not remove or alter any copyright, trademark, or other proprietary notices
- All rights not expressly granted in these Terms are reserved
Acceptable Use Policy
Permitted Uses
You may use the App and Content solely for:
- Personal French language learning and education
- Tracking your own learning progress
- Personal study and self-improvement
Prohibited Uses
You agree NOT to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Extract, scrape, copy, or reproduce the Content for any purpose outside the App
- Use the App or Content for any commercial purpose or financial gain
- Redistribute, sell, rent, lease, sublicense, or transfer the App or Content
- Use the App or Content to create derivative works or competing products
- Remove, obscure, or alter any proprietary notices on the App or Content
- Use the App in any way that violates any applicable laws or regulations
- Use the App to transmit malware, viruses, or other harmful code
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the integrity or performance of the App
- Use automated systems or software to extract data from the App (screen scraping, robots, spiders, etc.)
User Responsibilities
As a user of Doku, you are responsible for:
- Maintaining the security of your device and any data stored locally on it
- All activities that occur through your use of the App
- Complying with all applicable local, state, national, and international laws
- Ensuring that your use of the App does not violate any third-party rights
Parental Guidance: While Doku is suitable for users of all ages, we recommend that children under 13 use the App under parental guidance and supervision. Parents are responsible for monitoring their children's use of the App.
In-App Purchases and Subscriptions
Doku offers in-app purchases and subscriptions to access premium features and content. These purchases are processed through the Apple App Store or Google Play Store.
Payment and Billing
- All purchases are processed by Apple or Google, not directly by us
- Pricing and subscription terms are displayed in the App before purchase
- Subscriptions automatically renew unless cancelled before the renewal date
- We use RevenueCat to manage subscription status and entitlements
- Payment methods and billing are managed through your App Store or Play Store account
Cancellation and Refunds
- You can cancel subscriptions at any time through your App Store or Play Store account settings
- Refunds are subject to Apple's and Google's refund policies
- We do not directly process refunds; please contact Apple or Google support for refund requests
- If a subscription is cancelled, you will retain access until the end of the current billing period
- No refunds for partial subscription periods unless required by applicable law
Educational Disclaimers
Doku is designed as a supplementary language learning tool. You acknowledge and agree that:
- Supplementary Tool: The App is intended to supplement, not replace, comprehensive language instruction, formal education, or professional language courses.
- No Proficiency Guarantees: We make no guarantees, warranties, or representations about the level of French proficiency you will achieve through use of the App.
- Individual Results Vary: Language learning outcomes depend on numerous factors including time invested, learning style, prior knowledge, motivation, and individual aptitude. Your results may differ from others.
- Content Accuracy: While we strive for accuracy in all educational content, we do not guarantee that all Content is error-free, complete, or current. French language evolves, and regional variations exist.
- Not Professional Certification: Use of the App does not constitute professional language certification or accreditation. For official language certifications, please consult recognized testing organizations.
- Personal Responsibility: You are solely responsible for your learning journey and any decisions you make based on the Content or your perceived language proficiency.
Recommendation: For best results, we recommend using Doku as part of a broader language learning strategy that may include formal classes, conversation practice with native speakers, and immersion experiences.
Third-Party Services
The App integrates with certain third-party services to provide functionality:
- Apple App Store and Google Play Store: For app distribution, updates, and payment processing
- RevenueCat: For managing subscriptions and in-app purchase entitlements
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or policies of third-party services.
Apple App Store Requirements
The following provisions apply to users who access the App through the Apple App Store:
1. Acknowledgement
You acknowledge that these Terms are concluded between you and Yannick Herrero only, and not with Apple Inc. ("Apple"). You, not Apple, are solely responsible for the Licensed Application and the content thereof. To the extent these Terms provide for usage rules that are less restrictive than the Usage Rules set forth in the Apple Media Services Terms and Conditions, the more restrictive Apple terms apply.
2. Scope of License (Apple Devices)
The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. You may enable access to the App for other accounts associated with your account via Family Sharing or volume purchasing where applicable.
3. Maintenance and Support
Yannick Herrero is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. Warranty
Yannick Herrero is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Yannick Herrero.
5. Product Claims
You acknowledge that Yannick Herrero, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to:
- Product liability claims
- Any claim that the App fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
6. Intellectual Property Rights Claims
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Yannick Herrero, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
8. Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).
9. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Disclaimers and Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE APP AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
- WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE APP.
- YOU USE THE APP AT YOUR OWN RISK. YOUR DEVICE AND ANY DATA ON IT MAY BE AFFECTED BY BUGS OR ERRORS.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. You may have other rights which vary by jurisdiction.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
- WE SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP OR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Abuse or misuse of the App or Content
- At our sole discretion for any reason
You may stop using the App at any time by uninstalling it from your device.
Upon termination, all licenses granted to you will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and governing law provisions.
Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through:
- An in-app notification
- Updating the "Last updated" date at the top of these Terms
- Email notification (for significant changes, if available through app store)
Your continued use of the App after any modifications to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the courts of Montpellier, France, and you consent to the personal jurisdiction of such courts.
Nothing in this section shall prevent us from seeking injunctive relief or other equitable remedies in any jurisdiction to protect our intellectual property rights.
Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the App:
- Informal Resolution: We encourage you to first contact us at support@doku-reader.com to attempt to resolve the dispute informally.
- Good Faith Negotiation: Both parties agree to make a good faith effort to resolve any dispute through friendly negotiation before resorting to formal legal proceedings.
- Formal Proceedings: If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal proceedings in accordance with the Governing Law section above.
EU Consumers: If you are a consumer in the European Union, you may also have the right to lodge a complaint with your local consumer protection authority or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements and understandings, whether written or oral, regarding such subject matter.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
